Hulk Hogan is bringing his sex tape back to life. Hogan refiled his $100 million lawsuit in Florida court just months after he asked a judge to dismiss the suit in federal court. TMZ reports Hogan decided to dismiss the federal suit in order to consolidate his claims against Gawker and his sexual partner on the tape, Heather Clem, into one case. Hogan is suing both Gawker and Heather Clem — Hulk says he was secretly filmed and that Clem had a role in leaking the footage to Gawker.

The sex tape featuring Hulk Hogan having sex with Clem — who at the time was the wife of radio DJ Bubba the Love Sponge — was initially leaked to the website Gawker in early October 2012. The leaked video is in grainy black and white and is one minute of the 30-minute sex tape. It is also shot from an angle looking down onto a large canopy bed, as if the camera was placed on some sort of high shelf or in a ceiling corner.

What's a bit odd about Hulk Hogan's sex tape is that Hulk and Heather talk to a man off camera for a bit. Gawker and most others assume the off-stage presence was Heather's now ex-husband and Hogan's best friend, Bubba the Love Sponge. So while Hulk Hogan seems to have been aware he was in some kind of voyeuristic situation, the quality of the sex tape and placement of the camera suggest to us that Hogan likely didn't know he was being filmed.
The lawsuit Hogan filed for unspecified damages against Bubba the Love Sponge was settled out of court, and Sponge apologized on the air. Given the divorce of Bubba and Clem, it seems Sponge doesn't mind wathching his wife get nailed with a massive lawsuit — ahem.
